1. Who We Are
Wayht is a trading name of Tyler Hammond, a sole trader operating in England and Wales.

2. Acceptance of Terms
By downloading, accessing, or using the Wayht mobile application ("App"), you agree to be bound by these Terms of Use.
If you do not agree, you must not use the App.
You must be at least 16 years old to use Wayht.
3. Description of the Service
Wayht is a fitness tracking application that allows users to:
- Create and manage workouts
- Log exercises and performance data
- Store workout information locally on their device
- Sync workout data securely via Apple iCloud / CloudKit
- Access optional premium features through “Wayht Pro”
Wayht is provided for informational and organisational purposes only.
4. Health & Fitness Disclaimer
Wayht does not provide:
- Medical advice
- Diagnosis
- Treatment
- Rehabilitation guidance
- Personal training services
Exercise involves inherent risks, including serious injury or death.
You acknowledge and agree that:
- You participate voluntarily in any exercise logged in the App.
- You are solely responsible for determining whether you are medically fit.
- You should consult a qualified medical professional before beginning any exercise programme.
- You assume full responsibility for all risks associated with your activities.
To the fullest extent permitted by law, Wayht and Tyler Hammond disclaim liability for:
- Injury
- Illness
- Aggravation of existing conditions
- Equipment misuse
- Reliance on logged performance data
- User-created workouts
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence where such limitation would be unlawful.
5. Accounts & Authentication
Wayht uses Apple’s “Sign in with Apple” authentication service.
We do not maintain separate password systems.
You are responsible for safeguarding your Apple ID credentials.
Authentication and identity verification are managed by Apple under its own policies.
6. Wayht Pro Subscriptions
Wayht offers optional paid upgrades (“Wayht Pro”), which may include:
- Monthly subscription
- Annual subscription
- Lifetime one-time purchase
All purchases are processed via Apple In-App Purchases.
Billing & Renewals
- Subscriptions renew automatically unless cancelled.
- Billing is handled exclusively by Apple.
- You can manage or cancel subscriptions via your Apple ID settings.
Cancellation Rights (UK Consumer Transparency)
If you are based in the UK or EU:
- You may cancel your subscription at any time via Apple.
- Cancellation prevents future renewals.
- You will retain access until the end of the paid billing period.
- Refund requests must be made directly to Apple and are subject to Apple’s refund policies.
By purchasing a subscription, you expressly request immediate access to digital content. You acknowledge that this may limit statutory cancellation rights once access begins, in accordance with UK consumer law.
Your statutory rights under the Consumer Rights Act 2015 are not affected.
7. Intellectual Property
All intellectual property rights in the App, including:
- Branding
- Logos
- Interface design
- Exercise database
- Software code
are owned by Tyler Hammond unless otherwise stated.
You may not copy, modify, distribute, reverse engineer, or commercially exploit any part of the App without written permission.
8. Availability & Modifications
We may:
- Update the App
- Modify features
- Introduce paid functionality
- Suspend or discontinue services
without prior notice.
We do not guarantee uninterrupted availability.
9. Limitation of Liability
The App is provided on an “as is” and “as available” basis.
To the fullest extent permitted by law, we exclude liability for:
- Indirect or consequential loss
- Loss of profits
- Loss of business opportunity
- Data loss
- Sync failures
- Device incompatibility
- CloudKit outages
- Third-party service failures
We do not guarantee:
- Error-free operation
- Continuous availability
- Permanent data preservation
Your statutory rights under the Consumer Rights Act 2015 remain unaffected.
10. Artificial Intelligence & Future Features
Wayht may introduce AI or automated features in future updates.
Such features may:
- Analyse workout patterns
- Provide performance insights
- Suggest exercises
You acknowledge that:
- AI outputs are informational only.
- AI suggestions may be inaccurate or unsuitable.
- You remain solely responsible for decisions made based on such outputs.
AI features do not constitute medical or professional advice.
11. Data & Privacy
Your use of the App is governed by our Privacy Policy:

We may suspend or terminate access if:
- You breach these Terms
- You misuse the App
- Required by law
13. Dispute Resolution & Class Action Waiver
If you are located in the United States or any jurisdiction permitting such limitation:
You agree that disputes shall be resolved on an individual basis.
You waive any right to participate in:
- Class actions
- Collective proceedings
- Representative claims
This clause does not apply where prohibited by law.
If you are located in the United Kingdom, nothing in this section limits your statutory rights or access to courts under England & Wales law.
14. Governing Law
These Terms are governed by the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction, except where mandatory local consumer laws provide otherwise.
